By accessing and using QuiqOrder's automated WhatsApp ordering platform, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.
2. Description of Service
QuiqOrder provides an automated ordering system that integrates with WhatsApp Business API to enable businesses to receive, process, and fulfill customer orders through WhatsApp conversations. Our service includes:
- AI-powered chatbot for automated customer interactions
- Order processing and management system
- Payment processing integration
- Order tracking and customer notifications
- Business analytics and reporting tools
3. User Responsibilities
3.1 Account Security
- Maintain the confidentiality of your account credentials
- Notify us immediately of any unauthorized access
- Ensure accurate and up-to-date account information
3.2 Business Compliance
- Comply with all applicable laws and regulations
- Maintain necessary business licenses and permits
- Ensure product descriptions and pricing are accurate
- Handle customer data in accordance with privacy laws
3.3 WhatsApp Compliance
- Comply with WhatsApp Business Policy and Terms
- Obtain proper consent for business communications
- Respect customer preferences and opt-out requests
4. Prohibited Uses
You agree not to use QuiqOrder for:
- Illegal activities or prohibited products/services
- Spam, unsolicited communications, or harassment
- Fraudulent transactions or deceptive practices
- Violating intellectual property rights
- Circumventing or disrupting our security measures
- Reverse engineering or copying our technology
5. Payment Terms
- Subscription fees are billed in advance on a monthly basis
- Transaction fees apply to processed payments
- Refunds are subject to our refund policy
- You are responsible for all taxes related to your use of the service
- We reserve the right to change pricing with 30 days notice
6. Service Availability
While we strive to maintain high service availability, QuiqOrder is provided on an "as is" basis. We do not guarantee:
- Uninterrupted or error-free service
- 100% uptime or availability
- Compatibility with all devices or systems
- WhatsApp API availability (controlled by Meta/Facebook)
7. Intellectual Property
QuiqOrder and its original content, features, and functionality are owned by QuiqOrder and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
You retain ownership of your business data, content, and customer information while granting us necessary licenses to provide our services.
8. Limitation of Liability
To the maximum extent permitted by law, QuiqOrder shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation:
- Loss of profits, data, use, goodwill, or other intangible losses
- Damages resulting from service interruptions
- Third-party actions or WhatsApp service disruptions
- Unauthorized access to or use of our servers
9. Termination
Either party may terminate this agreement at any time. Upon termination:
- Your access to the service will be discontinued
- We will provide reasonable assistance for data export
- Outstanding payments remain due
- Survival clauses will remain in effect
10. Governing Law
These terms shall be governed by and construed in accordance with the laws of Nigeria, without regard to its conflict of law provisions. Any disputes arising from these terms will be resolved through the courts of Lagos, Nigeria.
11. Changes to Terms
We reserve the right to modify or replace these terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect. Your continued use of the service after such changes constitutes acceptance of the new terms.
